Acceptance of Terms

By accessing and using FamilyTree ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Use, please do not use the Service.

Description of Service

FamilyTree provides a genealogy tracking platform that allows users to store, organize, and manage family history records. The Service is available through both free and premium subscription tiers, with varying features and storage limits.

User Accounts

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Subscription and Payment

Premium subscriptions are billed on a recurring basis. By subscribing, you agree to:

• Pay all fees associated with your subscription tier
• Automatic renewal of your subscription until cancelled
• Provide current, complete, and accurate billing information
• Promptly update payment information if it changes

You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. No refunds are provided for partial subscription periods.

Usage Limits

Free tier accounts are limited to 50 family records. Premium subscribers have unlimited record storage. We reserve the right to modify usage limits with reasonable notice to users.

User Content

You retain all rights to the family records and genealogy data you upload to the Service. By using the Service, you grant us a limited license to:

• Store and process your content to provide the Service
• Create backups for data protection purposes
• Display your content back to you through the Service interface

You are solely responsible for the accuracy, legality, and appropriateness of the content you upload. You agree not to upload content that infringes on intellectual property rights, violates privacy rights, or contains illegal material.

Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to the Service or related systems
• Interfere with or disrupt the Service or servers
• Use automated systems to access the Service without permission
• Impersonate any person or entity or misrepresent your affiliation
• Upload malicious code, viruses, or harmful content
• Collect or harvest information about other users
• Resell or redistribute the Service without authorization

Intellectual Property

The Service, including its original content, features, and functionality, is owned by FamilyTree and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

Data Backup and Loss

While we implement industry-standard backup procedures, we recommend that you maintain your own backups of important family records. We are not liable for any data loss, corruption, or unavailability of your content.

Service Modifications

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your account settings.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAMILYTREE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify, defend, and hold harmless FamilyTree and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in the United States.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
